Supporting a Proscribed Organisation

Advice and guidance around when this offence could apply, and when it shouldn't apply.

Applies When

  • A person wears articles of clothing bearing symbols or icons of a proscribed organisation, but not necessarily the uniform of that proscribed organisation.
  • Symbols or icons worn by a person may not accurately represent those of a proscribed organisation, but they would lead a reasonable person to believe that they are.
  • A person hands out leaflets, newsletters or erects posters that promote or recruit for a proscribed organisation.
  • A person verbally promotes a proscribed organisation.

Doesn't Apply when

  • A person's clothing is similar in appearance to the uniform of members of a proscribed organisation, but is not in fact the uniform.
  • A person accepts literature promoting, or listens to verbal promotion of, a proscribed organisation.

Sentencing

Suggested sentences for those who have been convicted of this offence, and advice on the applicable conviction processes.

Suggested Sentences

  • 30 Silver Penalty
  • 3 Day Community Restitution Order
  • 12 Lashes

Due Process

  • Indictable Offence: A trial in the Crown Court, or a senior supervisor review is required in order for the suspect to be lawfully convicted and sentenced.
